Financial Leasing Contracts in Afghan Law and UNIDROIT Instruments (Nature and Effects).

On Wednesday, 26 Sunbula 1404, an academic seminar was held in the conference hall of Salam University by Dr. Mohammad Ali Amini, esteemed professor of the Master’s Program in Private Law at the Faculty of Law and Political Science, under the title: “Financial Leasing Contracts in Afghan Law and UNIDROIT Instruments (Nature and Effects).”

The program began under the moderation of Abdul Rahman Sabar, a second-semester Master’s student of Private Law, and opened with the recitation of verses from the Holy Qur’an by Idris Ehsan, also a second-semester student of the Private Law Master’s Program.

In this seminar, Dr. Amini conducted a comprehensive analysis of financial leasing by referring to the Afghan Leasing Law, domestic regulations, and international instruments such as the 1988 Ottawa Convention on International Financial Leasing and the 2008 Model Leasing Law.
Dr. Amini explained the importance of discussing financial leasing, stating that, on one hand, it is one of the most widely used contracts in many countries today, and on the other hand, examining it clarifies the legal nature of this contract. He suggested that it would be beneficial to establish an independent law so that financial leasing can be recognized as a distinct and independent contract. Such legal clarification would allow for a more accurate understanding of the legal framework surrounding financial leasing and help determine proper legal positions regarding this matter.

Dr. Amini emphasized that the nature of this contract differs from ordinary contracts. He explained its triangular structure and elaborated on the effects, rights, and obligations that this contract creates for its parties. The atmosphere in the hall was filled with academic enthusiasm and legal discussion. With clear and research-based explanations, Dr. Amini succeeded in presenting a relatively new and complex topic in a simple and scholarly manner.

In the end, professors and students raised their academic questions, and the session concluded with a scientific summary and motivational remarks from the Dean of the Faculty of Law and Political Science, followed by a closing prayer delivered by Aminullah Hemat, a student of the Private Law Master’s Program.
