The Weakness of Afghanistan’s Legal System and Its Impact on Migration

This research explores the weaknesses of Afghanistan’s legal system and its influence on migration. It analyzes national laws related to migration and assesses how effectively they help retain citizens within the country. A comparative analysis is also conducted with the legal systems of stable countries to highlight the structural and functional differences between them and Afghanistan’s legal framework.
The study finds that gaps in legislation and law enforcement, along with weak implementation of existing laws, have contributed to increased migration. The research method is based on document analysis and comparative review, supported by a statistical approach.
The results show that Afghanistan’s legal system faces serious challenges in lawmaking and coordination. As a result, it has not been able to manage the migration crisis or propose effective long-term solutions. Moreover, even when laws are properly drafted, poor enforcement has reduced their impact, this is supported by the data and statistics used in the study.
In conclusion, based on the experiences of stable countries, the study presents recommendations to improve Afghanistan’s legal system in order to reduce the current trend of migration.
